Terms of Service

These Terms of Service ("Terms") govern your use of the FreshGreet mobile application ("App") operated by FreshGreet ("we", "our", or "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App.

2. Account

You may use the App as a guest to browse and share gallery images. To access AI generation, prompt editing, and purchase features, you must sign in with a Google or Apple account. You are responsible for maintaining the security of your account credentials.

3. Subscriptions and Purchases

Subscription Plans. FreshGreet offers subscription plans with monthly generation quotas. Current plan details and pricing are displayed in the App and on the applicable app store listing. Features are identical across plans; only the generation quota differs. Prices may vary by region and currency.

Credit Packs. One-time credit packs are available as consumable in-app purchases. Credits never expire. Pack sizes and pricing are displayed in the App and on the applicable app store listing.

Billing. All purchases are processed through the Apple App Store or Google Play Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device's app store settings.

Refunds. Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

Free Tier. Free signed-in users receive 1 AI generation or edit per week. Additional generations can be earned by watching rewarded ads (up to 2 bonus generations per day). Free-tier usage includes ads.

4. Acceptable Use

You agree not to:

• Use the App to generate or share content that is illegal, hateful, violent, sexually explicit, or otherwise objectionable
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use automated scripts, bots, or scrapers to access the App or its content
• Circumvent usage limits, credit systems, or subscription restrictions
• Impersonate others or misrepresent your identity
• Use the App in any way that could damage, disable, or impair our services
• Resell or commercially redistribute images generated by the App without permission

We reserve the right to suspend or terminate accounts that violate these terms.

5. AI-Generated Content

Images generated by FreshGreet are created using AI (Google Gemini). While we strive for high quality, we do not guarantee that generated images will be free of errors, inaccuracies, or unintended content. You are responsible for reviewing generated images before sharing.

Gallery images generated through our batch process are available to all users. On-demand images you generate are stored privately in your account.

6. Intellectual Property

Our Content. The App, its design, branding, and batch-generated gallery images are owned by FreshGreet and protected by intellectual property laws.

Your Content. You retain rights to custom text and prompts you provide. AI-generated images created from your prompts are licensed to you for personal, non-commercial use including sharing on messaging platforms. You may not claim copyright over AI-generated images.

Share Attribution. When you share images via the App, a text attribution ("Sent with FreshGreet") may be appended to the share message. This text does not appear on the image itself.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

AI image generation depends on third-party services (Google Gemini API). We are not responsible for service outages, quality variations, or changes to third-party services beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, FreshGreet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or goodwill. Our total liability for any claim related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other reasonable means. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Malaysia.
